In Nietzsche verstehen, Christian Niemeyer aims at “correcting mistaken readings of Nietzsche” (10), by which he means clichéd misunderstandings of Nietzsche as a racist eugenicist, an advocate of a superiority of “German nature,” an anti-Semite, a warmonger, and a nihilistic negator of any ethics. In other words, the book addresses those aspects that portray Nietzsche as a kind of proto-Nazi. In doing so, Niemeyer also exposes the “genealogies” of such misreadings, in good Nietzschean style. The importance of Dilthey Why read Dilthey today? Why study the ideas of a nineteenthcentury German philosopher some seventy years after his death? ...

If one takes seriously the idea that a scientific language must be extensional, and accepts Quine’s notion of truth-value-related extensionality, and also recognizes that a scientific language must allow for singular terms that do not refer to existing objects, then there is a problem, since this combination of assumptions must be inconsistent. I will argue for a particular solution to the problem, namely, changing what is meant by the word ‘extensionality’, so that it would not be the truth-value that had (...) to be preserved under the substitution of co-extensional expressions, but the state of affairs that the sentence described. The question is whether or not elementary sentences containing empty singular terms, such as ‘Vulcan rotates’, are extensional in the substitutivity sense. Five conditions are specified under which extensionality in the substitutivity sense of such sentences can be secured. It is demonstrated that such sentences are state-of-affairs-as-extension-related extensional. This implies that such sentences are also truth-value-related extensional in Quine’s sense, but not truth-value-as-extension-related extensional. (shrink)

One of the most significant changes in modern healthcare delivery has been the evolution of the paper record to the electronic health record (EHR). In this paper we argue that the primary change has been a shift in the focus of documentation from monitoring individual patient progress to recording data pertinent to Institutional Priorities (IPs). The specific IPs to which we refer include: finance/reimbursement; risk management/legal considerations; quality improvement/safety initiatives; meeting regulatory and accreditation standards; and patient care delivery/evidence based practice. (...) Following a brief history of the transition from the paper record to the EHR, the authors discuss unintended or contested consequences resulting from this change. These changes primarily reflect changes in the organization and amount of clinician work and clinician‐patient relationships. The paper is not a research report but was informed by an institutional ethnography the aim of which was to understand how the EHR impacted clinicians and administrators in a large, urban hospital in the United States. The paper was also informed by other sources, including the philosophies of Jacques Ellul, Don Idhe, and Langdon Winner. (shrink)

This volume provides a unique overview and analysis of the philosophy and thought of Wilhelm Dilthey, and examines his writings in terms of their contemporary relevance. Rickman contends that the hub of Dilthey's work was his philosophy of the human studies, and that his ideas were directly relevant to the future of the social sciences. The book focuses on Dilthey's contribution not only to philosophy but also to history, psychology, sociology, anthropology, literary criticism, and the methodology of human studies in (...) general; his bearing on present-day concepts is documented by quotations from modern authors in these various fields. Es regelt die Bedingungen allseitiger Haftung eines Schuldners und steckt damit zugleich den Rahmen ab, innerhalb dessen die Gläubiger erwarten können, dass ihre Rechte in einer und durch eine Reorganisation und Sanierung des schuldnerischen Unternehmens gewahrt werden. Die faktische Wirkung des Insolvenzrechts endet nicht an nationalstaatlichen Grenzen. Das Insolvenzverfahren ist nach seinem Anspruch auf universelle Geltung angelegt. In fast allen Mitgliedstaaten der Europäischen Union (...) gilt heute als innerstaatliches Recht ein gemeinsames Recht grenzüberschreitender Insolvenzverfahren. Dieses gemeinsame europäische Recht strahlt auf die innerstaatlichen Reformbemühungen aus - es hat Einfluss auf die Insolvenzgesetzgebung. Die innerstaatlichen Gesetzgebungen werden zudem von UNCITRAL-Modellgesetzgebungen beeinflusst. Die wissenschaftliche Diskussion geht zusehends auf die damit ausgelösten Konvergenzbewegungen ein; die Praxis bedarf rechtsdogmatischer Aufklärung über die komplexer werdenden Regelungen des Insolvenzrechts und der Unterrichtung über die Strukturen und Problemstellungen ausländischer europäischer und außereuropäischer Insolvenzrechte, auch und gerade in ihrer Wechselwirkung mit dem deutschen Recht. Die Schriftenreihe der DZWIR ist ein Forum dieser Diskussionen. Sie wird in loser Folge monographische Untersuchungen zu Grundsatzfragen des deutschen, europäischen und internationalen Insolvenzrechts veröffentlichen. Gödel’s slingshot-argument proceeds from a referential theory of definite descriptions and from the principle of compositionality for reference. It outlines a metasemantic proof of Frege’s thesis that all true sentences refer to the same object—as well as all false ones. Whereas Frege drew from this the conclusion that sentences refer to truth-values, Gödel rejected a referential theory of definite descriptions. By formalising Gödel’s argument, it is possible to reconstruct all premises that are needed for the derivation of Frege’s thesis. For (...) this purpose, a reference-theoretical semantics for a language of first-order predicate logic with identity and referentially treated definite descriptions will be defined. Some of the premises of Gödel’s argument will be proven by such a reference-theoretical semantics, whereas others can only be postulated. For example, the principle that logically equivalent sentences refer to the same object cannot be proven but must be assumed in order to derive Frege’s thesis. However, different true (or false) sentences can refer to different states of affairs if the latter principle is rejected and the other two premises are maintained. This is shown using an identity criterion for states of affairs according to which two states of affairs are identical if and only if they involve the same objects and have the same necessary and sufficient condition for obtaining. In the following the details of a state-of-affairs semantics for positive free logic are worked out, based on the models of common inner domain - outer domain semantics. Lambert's PFL system is proven to be weakly adequate (i.e., sound and complete) with respect to that semantics by demonstrating that the concept of logical truth definable therein coincides with that one of common truth-value semantics for PFL. Furthermore, this state-of-affairs semantics resists the challenges stemming from the slingshot argument since logically equivalent (...) statements do not always have the same extension according to it. Finally, it is argued that in such a semantics all statements of a certain language for PFL are state-of-affairs-related extensional as well as salva extensione extensional, even though their salva veritate extensionality fails. This volume presents a selection of Professor Rickman's essays published over a period of 40 years. They reflect his view of philosophy and defend it against attacks on two fronts. On one side the assault comes from a substantial proportion of professional philosophers particularly in the Anglo-Saxon world, who treat philosophy as a purely academic, highly technical subject, dealing merely with the clarification of concepts, the solving of logical puzzles and the refutation of similarly abstruse theories of fellow philosophers. On (...) the other side there is the widespread popular view of philosophy as dealing with abstract problems remote from everyday life and invented by philosophers in their ivory towers. In classical physics, the world is considered as a matter-based reality, the arrangement of whose parts in time is uniquely determined by certain dynamic laws. By contrast, modern quantum physics reveals that matter is not composed of matter, but reality is merely potentiality. The world has a holistic structure, which is based on fundamental relations and not material objects, admitting more open, indeterministic developments. In this more flexible causal framework, inanimate and animate matter are not to be considered as fundamentally (...) different but as different order structures of the same immaterial entity. In a stable configuration, effectively all the uncertainties are statistically averaged out, thus the unique and deterministic behavior of ordinary inanimate matter is exhibited; whereas in the case of statically unstable but dynamically stable configurations, the “lively” features of the underlying quantum structure have a chance to surface to the mesocopic level and to be connected with what we observe as the phenomenon of life. This supposition can be more explicitly treated and clarified by identifying the electric dipole moment of biomolecules as the ordering parameter of the corresponding macroquantum system. This has important consequences for biology and medicine. In particular, it suggests the existence of a quantum-based “software,” essential perhaps for the logistics of biological processes, which are hidden behind the matter/energy-based “hardware” that alone is considered in the conventional approach. In medicine it opens an opportunity to build bridges between conventional medicine based essentially on the classical paradigm, and the various forms of complementary medicine, which have strong affinities with the new features of the modern holistic worldview. In Popper's Logik der Forschung, a theoretical system is a set of sentences that describe a particular sub-area of science, in particular of empirical science. The goal of axiomatizing a theoretical system is to specify a small number of "axioms" describing all presuppositions of the sub-area under consideration, so that all other sentences of this system can be derived from them by means of logical or mathematical transformations. The paper discusses two philosophical interpretations of these proper axioms. First, proper axioms (...) stipulate the use of the signs for the basic concepts of the system. Consequently, the proper axioms turn out to be analytic relative to a class of interpretations of the underlying logic. Hence, they cannot be falsified by refuting their logical consequences because these consequences are analytic as well. Secondly, proper axioms are synthetic, falsifiable and uncertain sentences. Hence, they are not immunized against falsification by refuting their logical consequences. (shrink)

The search for the extensions of sentences can be guided by Frege’s “principle of compositionality of extension”, according to which the extension of a composed expression depends only on its logical form and the extensions of its parts capable of having extensions. By means of this principle, a strict criterion for the admissibility of objects as extensions of sentences can be derived: every object is admissible as the extension of a sentence that is preserved under the substitution of co-extensional expressions. Biochemical and genetical analysis of plant transposons has shown that these elements can induce unstable mutations and also that the transposon structure can be altered in different ways. Upon insertion, a transposon can give rise to a variety of chromosomal changes in the vicinity of the insertion site. The alterations range from the nucleotide level to large‐scale rearrangements.

In German discussions over the last twenty years of the difference between what it is to be a body (in German: Leibsein) and what it is to have a body (Körperhaben), many have been concerned to remind us that we owe this conceptual distinction to the philosophical anthropologist Helmuth Plessner. He introduces the distinction in an essay from 1925—written in collaboration with the Dutch behavioral researcher Frederick Jacob Buytendijk—“Die Deutung des mimischen Ausdrucks. Ein Beitrag zur Lehre vom Bewusstsein des anderen (...) Ichs” (“The Interpretation of Mimetic Expressions: A Contribution to Understanding One’s Consciousness of Other Subjects”). Two disciplines claim to provide justification of action. Ethics gives you moral reasons to act upon, whereas economics exploits the concept of rationality. The paper discusses two theories of interdisciplinarity of ethics and economics in order to clarify the relationship. The traditional view of a hierarchical ordering of ethics and economics is rejected, and it is claimed that there are substantial economic contributions to ethical justification.

Why has the global West (North America, Europe) handled the covid-19 pandemic and the corresponding economic crisis so much worse than the global East (East Asia)? The crises demonstrate the degree to which the West is shaped by its forms of competition and the East by its forms of cooperation. In the West, we have become habitualised to American neoliberalism over the last two generations. In the East, varieties of neo-Confucianism and neo-Buddhism have been transformed into national cultures. The way (...) humans understand their position in the world intellectually and react to crises according to corresponding habit makes an effective difference. The present comparison between global East and West makes use of Hannah Arendt’s conception ofpoliticsand theshared worldas well as of Helmuth Plessner’s conception ofmediated immediacyin forms ofmodern biopower. IntroductionAlthough a few studies suggest that young overweight to obese children and adolescents may have impaired postural control compared to young normal-weight peers, little information exists about how these two groups differ in the quality of the underlying balance strategies employed. Hence, the aim of the present study was a first comprehensive examination of the structural complexity of postural sways in these two cohorts during quiet bilateral standing.MethodsNineteen YO secondary school students were carefully matched to YN controls for age, sex, (...) height, and school. Mediolateral and anteriorposterior acceleration signals were recorded with an inertial measurement unit positioned at the trunk while standing barefoot in two conditions: firm and foam support surface. The magnitude of postural fluctuations was obtained using the root mean square. The temporal structure of the signals was analyzed via sample entropy, largest Lyapunov exponent, and detrended fluctuation analysis algorithm. Reliability was assessed using a test–retest design.ResultsIn both groups, foam standing caused higher postural fluctuations and reduced structural complexity. In comparison to YN, YO exhibited a higher RMSAP. Especially in ML direction, the acceleration signals of the YO had higher repeatability, greater long-range correlations, and lower local stability. However, these observations were largely independent of the task difficulty. Except for α-DFAAP, the IMU approach proved reliable to characterize posture control.DiscussionOur outcomes confirm postural control deficits in YO compared to their YN peers and indicate impaired regulatory mechanisms reflected as rigidity. Such less complex patterns usually reflect diverse pathologies, are detrimental to compensate for internal or external perturbations, and are attributed to lower adaptability and task performance. Without targeted balance stimuli, YO likely end in a lifelong vicious circle of mutually dependent poor balance regulation and low physical activity. (shrink)

According to the principle of compositionality, the meaning of a composed expression depends only on its logical form and the meaning of its descriptive sub-expressions. This dependence can be understood as the substitutivity of expressions that have the same meaning without changing the meaning of the composed expression. In this book the hidden complexity of Frege's and Quine's conceptions of extensionality is revealed. The insights gained by this analysis as well as two versions of the principle of compositionality are used (...) in a formal reconstruction of Gödel's and Quine's versions of the slingshot argument. Empty individual expressions are needed to reconstruct the actual use of scientific language as well as to make logic free from existence assumptions. According to Quine, a language must be extensional to be adequate for the purposes of science. By means of Lambert's non-extensionality argument it can be demonstrated that a language containing empty individual expressions cannot be extensional as long as truth-values are the extensions of sentences. This book investigates the soundness of Lambert's argument and examines the question of (...) whether and how extensionality of a language for free logic can be secured. To achieve these aims, the notion of extensionality is thoroughly analyzed and two new semantic approaches to free logic are developed in which states of affairs, but not truth-values, are the extensions of sentences. These two semantic approaches are defended against the slingshot argument. In this way, two possible solutions to the problem of extensionality arise which use non-existent objects in two different ways: whereas in dual domain semantics non-existent objects serve as referents of empty singular terms, in single domain semantics they serve as hole marker objects that mark the holes in states of affairs where an object is missing due to an irreferental individual expression. A sudden paradigm shift has resulted in governmental measures that greatly impact the scope in which the ethics committees in Germany can perform their task of providing expert opinions for clinical research. The so-called “revaluation” of the Medical Device Law Deutsches Medizinproduktegesetz—MPG) is, in our opinion, not based on sound political and professional judgment. In accordance with the changed regulations, ethics committees are now seen as being sub-organs of the state medical associations or the medical faculties and are therefore official (...) authorities. It follows that the votes of ethics committees are then “sovereign acts” or authoritative measures! However, equality and justice speak against this misleading conclusion and its resulting consequence that an ethics committee’s vote is a sovereign act. This has, in turn, resulted in the public ethics committees obtaining their long-sought goal of having a state-sanctioned monopoly. The private ethics committees are not recognized as being authoritative bodies, nor are they to be seen as such in the future (i.e. such a status has been denied the Freiburg Ethics Commission International (FEKI) in Baden-Württemberg). This political mistake must be corrected, otherwise, conducting clinical research will become increasingly difficult. (shrink)

This paper develops a model of political consensus in order to explain the missing link between inequality and political redistribution. Political consensus is an implicit agreement not to vote for extreme policy proposals. We show that such an agreement may play an efficiency-enhancing role. Voters anticipate that voting for extremist parties increases policy uncertainty in the future. A political consensus among voters reduces policy uncertainty because self-interested politicians propose non-discriminatory policies. We study how much inequality can be sustained in a (...) democracy and how the limits to redistribution vary with initial inequality. The bounds of the set of political equilibria may react in a fundamentally different manner to changes in exogenous variables than do the policy variables in the one-dimensional, one-shot game. More initial inequality need not lead to more redistribution from the rich to the poor. The maximum amount of redistribution decreases with inequality if (and only if) agents are sufficiently patient. In this case inequality is politically self-sustaining. (shrink)

The protection of human research subjects in clinical studies is regulated by international guidelines and national laws. Research Ethics Committees play an important role here, as they review the documentation for clinical studies under consideration of ethical aspects. This documentation includes an exclusion or wash-out period which designates when study subjects may not have participated in another study or be allowed to take part in a future one within a specified time period. However not all research subjects comply with their (...) applicable exclusion period. This prohibited multi-participation in clinical studies is known as ‘research subject tourism,’ ‘clinical study overlapping’, or ‘guinea-pigging’. This practice brings with it additional risks for the research subject and the integrity of the research being conducted. No comprehensive data are available to demonstrate exactly how many research subjects participate in overlapping multiple studies. However, the number of them who ‘travel’ from one study to another seems to be significant. Preventing this practice is a matter of concern for ethics committees, but the responsibility for protecting research subjects in this respect apart from approving the ethics of a wash-out period and recruiting from a specific pool or database of patients is solely that of the investigating physician. But how can the investigating physician be certain that a research subject complies with their exclusion period? An international data bank for research subjects who have participated, or are participating, in clinical studies, is a measure that would serve to prevent prohibited multi-participation in clinical studies and thereby protect the research subject, the investigating physician and their institution. VIP Check, International, which was founded by the author in 1990, is an example of such a data bank. This article examines the existence of prohibited multi-participation in clinical studies, the additional risk this practice of itself poses to the research subjects and the integrity of clinical studies, and how this practice might best be reduce or even eliminated through use of an international data bank of research subjects such as that of VIP Check. This essay considers the work of Jean-Luc Nancy on touch as a model for a conception of the musical body. More than a re-emphasizing of the tactile, though, it is possible to show that Nancy’s work enables an understanding of music as touch. The significance of this re-thinking lies in the counterweight it provides to the degradation of music entailed in its digitalized de-materialization. Hegel is seen to be complicit in this degradation.

Abstract John McDowell argues for minimal empiricism via using the notion of second nature of human beings. I should like to invite him to discuss Helmuth Plessner's Philosophical Anthropology in order to elaborate a more substantial conception of second nature. McDowell seems to think that it is adequate for his more epistemological aim to remind us of second nature as though it were to be taken for granted. But I think, following Plessner, that this right reminder needs a therapeutic elaboration (...) in Kant's sense of propaedeutics. What had been called our second nature found itself being questioned in order to limit the range of ways of treating the self we can authorize. (shrink)

Though Helmuth Plessner (1892-1985) elaborated his philosophical anthropology independently of the classical pragmatisms, there are many parallels with them. He combined a phenomenology of living beings (a parallel with William James) with a semiotic reconstruction (a parallel with Charles Sanders Peirce) of what we are already using whenever we specify living beings, among them ourselves as human living beings in nature, culture, and society. In Plessner’s distinction between having a body (Körperhaben) and being (or living) a body (Leibsein), there is (...) a parallel with George Herbert Mead’s “Me” (taking over the perspective of others) and “I” (spontaneous actions/reactions of an organism in a situation). Dewey and Plessner elaborated a public procedure for overcoming the old dualism of matter and idea in a process of learning better habits. Their historical conceptions of communication involve the primacy of interactions on three levels (discursive, conscious, pre-conscious living). Facing the plasticity of human conduct, both approaches open the door to a pluralistic self-understanding that includes value-conflicts and that therefore needs civilized forms to solve such conflicts. With regard to the limits of human conduct, Plessner proposed a phenomenology (of laughing and crying) that seems to have no equivalent in pragmatism. (shrink)

SummaryThough Peter Gordon mentioned philosophical anthropology in his book Continental Divide, he has not yet realized how it works independently from Cassirer's and Heidegger's prejudices. The whole argument between them before, in and after Davos raged around the status of philosophical anthropology: How do the spiritualisation of life and the enlivening of the spirit come about? This was not just the central question for philosophical anthropology founded by Max Scheler, but also in Wilhelm Dilthey's life philosophy, which was systematized (...) by Georg Misch. Cassirer and Heidegger shared three shortcomings with respect to the Life-philosophical Anthropology. Neither had a philosophy of nature or a philosophy of sociaty or a philosophy of history. The insight into the unfathomability of humans is given a political edge in Helmuth Plessner's book Power and Human Nature. Elevating it to the principle of democratic equality with respect to the worth of all cultures one opens up the potential for a form of civil competition that might supersede ethnocentric wars. Responsibility means not just to give the right response to a question. It should not necessarily succeed to ask and respond about acts, and to submit them to some discursive rules. In fact, responsibility is related to an indefinite questioning: How could some question-answer-rules, which consequences exceed a situation, be adequately applied to this situation? To give an answer to this questionability, it would be necessary to move in a self-relating language as well as in a distancing intuition. Scientific policy advice is usually perceived as a formalized advisory process within political institutions. Politics has benefited from this arrangement because the science-based rationalization of policy has contributed to its legitimacy. However, in Western democratic societies, scientific expertise that is routinely mobilized to legitimate political positions has increasingly lost its power due to controversial expertise in the public sphere in particular within the mass media. As a consequence of the medialization of science, political decision makers are increasingly confronted with mass-mediated (...) expertise. Empirical results of a qualitative survey among decision makers in the German political and administrative system, presented in this article, support the hypothesis that mass-mediated expertise has a significant impact on policy processes. Five functions of media coverage on science-based issues for policy making were identified. Mass-mediated expertise has therefore altered the established relations between scientific policy advisors and political decision makers and can be seen as informal policy advice complementing institutionalized advisory arrangements. In the first part the text specifies Hannah Arendt's philosophical approach in three dimensions: a) She used Max Scheler's new phenomenology of living beings . b) She transformed Karl Jaspers' extraordinary limit situations of human conduct into anthropological conditions. c) Such conditions are questions that do need answers in forms of "vita active" and of "vita contemplative". Arendt moved from Max Scheler's Philosophical Anthropology to her own historical conception of the human condition inside the heterogeneity of our Occidental tradition. The (...) second part of this paper gives an overview about her network of concepts that enables a comparison of Occidental cultures via the change of dominance in relations of vita active and vita contemplative. The third part situates her approach between those of Michel Foucault and Charles Taylor in a debate that is needed at present. Talking of „democracy as a way of life“ is not as clear-cut as it immediately appears. Democracy is a form of a state. To what extent can it then also be called a form of life? The expression seems to apply to the whole life of people and thus not only to a form of state. In the sense of Wittgenstein‘s talk of the form of life or forms of life (vgl. Grosshans 2013, 183-9), democracy as a form of life (...) would then be understood as a specific cultural context of life with which a whole series of general attitudes to life are connected. The hallmark of modern - in the sense of today‘s - democracies, however, is the plurality of social systems (in the sense of Luhmann’s sociology) in the states in which we live. Political philosophy has also devoted itself extensively in recent decades to the question of how the ideological, cultural and religious plurality of citizens in democracies should be present in the public space in which the general will of the people is discursively determined. Against this background, the paper will present some aspects of the relationship of Christianity to democracy. First, some problems that arise with a formal understanding of democracy will be presented. Then, fundamental problems that traditional constellations of Christianity entail for democracy will be discussed. This is followed by reflections on a constructive relationship of Christianity to political law on the background of Protestant theology, which are then turned against currently present forms of religious politics. Finally, the relevance of human rights for democracy and the rule of law is discussed, again from the perspective of Protestant theology. (shrink)

Clinical photography in the late 19th century aimed at unveiling the hidden processes invisible to the clinical eye. Changes in the outer form hinted at deeper lying causes, and decoding these forms was supposed to extend the range of the clinical eye into the realm of invisibility. Two suppositions supported this hope: the belief that each disease as an ontological entity showed typical exterior signs which allowed a diagnosis at sight, and the technological trust in photography as a precise and (...) objective means of representation superior to the human eye. For a short time, clinical photography seemed to be the “via regia” of diagnosis. Heinrich Curschmann's Klinische Abbildungen and Ludwig Jankau's periodical Internationale medizinisch-photographische Monatsschrift marked the climax of this development in Germany. Röntgen's discovery and its immediate application in clinical medicine put an end to the optimistic expectations: clinical photography was from now on only one among many different means of documenting clinical signs and findings.
